Sidestep and Suprise

Ok, just to make sure I have this correct..
It's the attacker's turn and has initiative.
The defender uses a sidestep defence and is successful. The defender moves outside the attacker's ZOC (and is not in BTB anymore).
On the defender's turn a melee exchange is declared... the question: is the attacker is now suprised?

The model using Sidestep Defence is able to leave the enemy ZoC into its rear arc.  
If it does so, when it declares the melee action, it begins out of LoS, so as long as the other requirements are met the enemy will be surprised.
